Trademark registration process in India?

The trademark registration procedure in India is as follows:

Step 1: Trademark Search

Step 2: Filing the Application (Form TM-A)

The application for registration is made using Form TM-A. This can be done online through the IP India website or application can be made for multiple classes.

Step 3: Examination by the Registrar

The Trademark Registry will examine the application for compliance with formalities and substantive requirements such as distinctive and likelihood of confusion with other trademarks.

Step 4: Examination Report and Response

If there are objections, you must respond to them within the simulated time. Otherwise, the application will be abandoned.

Step 5: Publication in the Trademark Journal

After acceptance, the trademark is published in the Trademark Journalism. This will remain open for opposition by the public for four months.

Step 6: Opposition Proceedings (If Any)

If there is an opposition, the case will proceed to pleadings and hearings before the Registrar.

Step 7: Registration Certificate

If there is no opposition or if the opposition is in your favor, the Registrar will issue the registration certificate. You can then use the ® symbol.
